A través del presente Aviso Legal se regulan las condiciones de uso y de navegación de esta Plataforma Web (en adelante, “la Plataforma”).

El acceso, navegación y utilización de la Plataforma implica ostentar la condición de usuario de la misma (en lo que sigue, “el usuario”) y, por consiguiente, la aceptación expresa y sin reservas por parte del usuario de todos los términos y condiciones contenidos en el presente Aviso Legal, motivo por el cual recomendamos su lectura detenida.

1. INFORMACIÓN GENERAL

En cumplimiento de lo previsto en la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico, se le informa que el titular de la Plataforma es Fundación para la Investigación del Síndrome de Dravet (en lo sucesivo, “FSD” o “nosotros”), inscrita en el Registro de Fundaciones bajo el nº 1744, con C.I.F. G-87042701, y domiciliada en C/ Toledo, 46, Planta 1, 28005 Madrid


2. PLATAFORMA WEB: USO, FINALIDAD Y RÉGIMEN JURÍDICO APLICABLE

La Plataforma es un espacio digital que la Fundación Síndrome de Dravet pone a disposición de los usuarios como herramienta de soporte y comunicación. Su finalidad principal es facilitar el acceso a información actualizada sobre el síndrome de Dravet, promover la participación en programas de investigación, formación y sensibilización, así como ofrecer recursos para mejorar la calidad de vida de las personas afectadas y sus entornos. Además, la Plataforma fomenta la creación de entornos inclusivos y accesibles, impulsando iniciativas que contribuyan a la integración social y al desarrollo de proyectos colaborativos orientados a la innovación en salud y bienestar.

En lo que respecta a la Plataforma, la misma se sujeta asimismo a la legislación española, resultando de aplicación la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico.

3. ACEPTACIÓN DE LAS CONDICIONES DE USO

El acceso a todas las funcionalidades dispuestas en esta Plataforma implica la aceptación de todas y cada una de las presentes condiciones, así como cualquier otra que se pueda establecer, modificar y/o ampliar por necesidades del Servicio presentes o futuras. FSD quedará facultada para modificar en cualquier momento el contenido de dichas condiciones, así como de los servicios y funcionalidades dispuestas a través de la Plataforma entendiéndose como suficiente la publicación de tales cambios y modificaciones a través del presente medio.

4. CONDICIONES DE ACCESO Y UTILIZACIÓN

El usuario se compromete a hacer un uso adecuado y lícito de la Plataforma, así como de los contenidos, productos y servicios dispuestos a partir de la misma, de conformidad con la legislación aplicable en cada momento, las presentes condiciones, la moral y buenas costumbres generalmente aceptadas y el orden público.

En general, el acceso a las distintas funcionalidades existentes en la Plataforma, dependerán del perfil de usuario de que se trate, debiendo éste registrarse y proceder al alta previa que corresponda en su caso, mediante un sistema de contraseñas que le serán asignadas y que puede modificarlas en cualquier momento, responsabilizándose de su custodia y estando estrictamente prohibida su cesión a terceros no autorizados.

Por tanto, el usuario que se registre se obliga a adoptar las medidas de seguridad necesarias para mantener la confidencialidad de los sistemas o códigos de acceso y de verificación establecidos en relación con la Plataforma, por lo que FSD quedará liberada de cualquier responsabilidad al efecto por la negligencia, descuido o uso indebido por parte del usuario o de cualquier tercero en este ámbito.

Asimismo, el usuario de la Plataforma se compromete a lo que sigue:

  • Garantizar la autenticidad, veracidad, actualidad y exactitud de todos aquellos datos que comunique a través de la Plataforma, resultando tal usuario el único responsable en caso contrario. 
  • Usar la Plataforma de forma exclusiva para los fines y funcionalidades dispuestas a tal fin por FSD quedando prohibido para el usuario usar la Plataforma para cualquier otro fin o medio. 
  • Hacer un uso legal y legítimo de la Plataforma, evitando un uso no autorizado, fraudulento, ilegal o ilegítimo de la misma y/o de los contenidos e información dispuestas a través de ésta, evitando vulnerar el presente Aviso legal y la normativa aplicable, y dañar los derechos e intereses legítimos de FSD o de cualquier otro tercero que pudiera verse afectado como consecuencia de tal actuación.
  • No provocar daños en los sistemas físicos o lógicos de la Plataforma, de sus proveedores o de terceros, o intentar quebrantar las medidas de seguridad o autenticación del mismo, llevar a cabo alguna acción que provoque una saturación desproporcionada o innecesaria en la infraestructura o del entorno de comunicaciones relacionado con la Plataforma y el Servicio, atacando de cualquier modo al mismo. FSD podrá adoptar cuantas medidas preventivas o correctoras resulten necesarias para proteger sus intereses en orden al correcto funcionamiento de la Plataforma, el Servicio y sus funcionalidades específicas.
  • No introducir o difundir en la red virus informáticos o cualesquiera otros sistemas físicos o lógicos que sean susceptibles de provocar daños tales como virus, código malicioso u otros programas o archivos perjudiciales.
  • No intentar acceder, utilizar y/o manipular los datos de FSD, o bajo su responsabilidad, o de terceros proveedores y de otros usuarios; En particular, y a título meramente indicativo y no exhaustivo, el usuario se compromete a no transmitir, difundir o poner a disposición de terceros informaciones, datos, contenidos, mensajes, que puedan ser constitutivos de vulneración de derechos de FSD o de terceros.
  • Acceder sin autorización o interactuar con una identidad falsa, suplantando o no la identidad de terceros o utilizando un perfil o realizando cualquier otra acción que pueda generar confusión o inducir a error acerca de la correcta identificación del usuario de que se trate.

5. PROPIEDAD INDUSTRIAL E INTELECTUAL

El usuario reconoce y acepta que todos los derechos de propiedad industrial e intelectual sobre los contenidos y/o cualesquiera otros elementos de la Plataforma (incluyendo sin limitación, marcas, logotipos, nombres comerciales, textos, imágenes, gráficos, diseños, sonidos, bases de datos, software, presentación, audio y vídeo, de introducirse), son propiedad exclusiva de FSD o de terceros que han autorizado específicamente a FSD a tal fin.

En ningún caso el acceso o navegación por la Plataforma implica ningún tipo de renuncia, transmisión, licencia o cesión total ni parcial de dichos derechos, salvo que se establezca expresamente y por escrito lo contrario.

Quedan reservados todos los derechos de propiedad intelectual e industrial sobre los contenidos y/o servicios de la Plataforma y, en particular, queda prohibido modificar, copiar, reproducir, comunicar públicamente, transformar o distribuir, por cualquier medio y bajo cualquier forma, la totalidad o parte de los contenidos incluidos en el mismo con fines públicos o comerciales, si no se cuenta con la autorización previa, expresa y por escrito de sus respectivos titulares.

El usuario que vulnere estas limitaciones y prohibiciones reconoce asumir en exclusiva cualquier responsabilidad al respecto, dejando indemne a FSD o a cualquier otro tercero que pudiera verse afectado como consecuencia de la actuación del usuario.

6. EXCLUSIÓN DE GARANTÍAS Y RESPONSABILIDAD

FSD no garantiza la disponibilidad y continuidad del funcionamiento de la Plataforma. Asimismo, no será en ningún caso responsable por cualesquiera daños y perjuicios que puedan derivarse de:

  1. La interrupción en el funcionamiento de la Plataforma o fallos informáticos, averías, desconexiones, retrasos o bloqueos causados por deficiencias o sobrecargas en torno a los sistemas o mecanismos que permiten su funcionamiento;
  2. La falta de idoneidad de la Plataforma para las necesidades específicas de los usuarios y;
  3. Otros daños que puedan ser causados por terceras personas mediante intromisiones no autorizadas ajenas al control de FSD

No se garantiza la ausencia de virus ni de otros elementos en la Plataforma introducidos por terceros ajenos a FSD y que puedan producir alteraciones en los sistemas físicos o lógicos de los usuarios o en los documentos, archivos y ficheros almacenados en sus sistemas.

FSD adoptará diversas medidas para proteger la Plataforma y los contenidos contra ataques informáticos de terceros. No obstante, no garantiza que terceros no autorizados no puedan tener acceso al tipo de uso de la Plataforma que hace el usuario o las condiciones, características y circunstancias en las cuales se realiza dicho uso. En consecuencia, no será en ningún caso responsable de los daños y perjuicios que pudieran derivarse de dicho acceso no autorizado.

FSD se reserva el derecho a suspender sin previo aviso el acceso a los usuarios que, a su juicio, incumplan las normas de utilización de la Plataforma y a ejercer las medidas legales oportunas, sin que por ello se genere derecho indemnizatorio alguno a favor del usuario que pudiera verse afectado por ello.

FSD no se hará responsable en ningún caso del uso que los usuarios y/o terceros pudieran hacer de la Plataforma, ni de los daños y perjuicios que pudieran derivarse del mismo.

FSD excluye cualquier responsabilidad por los daños y perjuicios de toda naturaleza que pudieran deberse a la utilización de los servicios y de los contenidos por parte de los usuarios, o que puedan deberse a la falta de información, exactitud o falta de veracidad de la información que éstos proporcionan en el marco de la Plataforma y el Servicio, y en particular, aunque no de forma exclusiva, por los daños y perjuicios de toda naturaleza que puedan deberse a la suplantación de la personalidad de un tercero efectuada por un usuario en cualquier clase de comunicación o actuación realizada a través de la Plataforma

7. JURISDICCIÓN Y FUERO APLICABLE

Cualquier controversia en relación con el presente Aviso Legal se sustanciará ante la jurisdicción española, acordando expresamente las partes someterse a la jurisdicción de los Juzgados y Tribunales de la Ciudad de Madrid, salvo que la normativa de aplicación establezca la competencia de otros Juzgados y Tribunales a esos efectos.

8. MODIFICACIÓN AVISO LEGAL

FSD sereserva el derecho de modificar el presente Aviso Legal, para adaptarlo a futuras novedades legislativas, doctrinales o jurisprudenciales que resulten de aplicación, o por motivos técnicos, operativos, comerciales, corporativos y de negocio, informando previa y razonablemente a los usuarios de los cambios que se produzcan cuando ello sea posible. En todo caso, se recomienda que cada vez que se acceda a esta Plataforma se lea con detalle este Aviso Legal.

TERMS & CONDITIONS

The Dravet Syndrome Conference 2023 is organised by Dravet Syndrome Foundation Spain, whose registered office is located at Calle Doctor Fleming, 30, 28036 Madrid, Spain.

The conference shall take place at the Official College of Nursing of Madrid, at Avenida de Menéndez Pelayo, 93, 28007 Madrid, Spain, on Thursday 23rd of March 2023. Attendance to this conference is free of charge, but mandatory for organisational reasons.

Participants must register online at www.dravetconference.com. Upon registration, each participant will receive an electronic confirmation by email. On-site registration will not be be possible. If a participant has not received the official email registration confirmation within 3 days, they must contact the conference secretariat at research@dravetfoundation.eu.

The conference registration includes: Attendance to all sessions, oral and visual presentations, all coffee and lunch breaks, and conference documentation with all information about the event. The registration does not include travel and accommodation costs or any other personal expenses.

Admittance to the conference without registration cannot be granted.

Conference Attendance
Upon arrival at the Official College of Nursing of Madrid the day of the event, all participants have to check-in at the onsite Conference Registration Desk. The desk will open on 23rd of March at 8:30 a.m. Upon registration onsite, the conference team will provide participants with information about the event and a badge, which should be worn visibly at all times. The personalised badge authorises participants to attend all conference sessions, and lunch and coffee breaks.

Cancellation Policy
Dravet Syndrome Foundation Spain reserves the right to cancel any registration forthwith and without liability on its part in the event of any damage to, or destruction of the venue by fire, shortage of labour, strikes, industrial unrest, public health measures, or any other cause beyond the control of the Dravet Syndrome Foundation Spain, which shall prevent it from performing its obligations. In these circumstances, every effort will be made to find an alternative format/venue or propose a new date for the conference. Should the conference be cancelled for any reason, airfares, hotels, or other costs incurred by the participants are not reimbursed by the Dravet Syndrome Foundation Spain.

Any participant is allowed to cancel his/her registration but must notify this to the conference organisers by e-mail at research@dravetfoundation.eu within a minimum of 10 days prior the event. Failure to attend the event without prior written notification by email may incur a no-show fee, which shall cover individual organizational, material and catering costs.

Name Change
All registrations are only valid for the respective person mentioned in the form. A registered participant unable to attend the conference may nominate (free of charge) a substitute participant by notifying the conference organisers by email at research@dravetfoundation.eu before 16th of March 2023. The procedure allows giving the last name, first name, and email address of the new participant.

Personal Data
Upon registration, the participant authorises Dravet Syndrome Foundation Spain to use their personal data stated above to inform the participant of any further conferences, events, or information concerning the conference and Dravet Syndrome Foundation Spain’s activities. The conference booklet online will only contain authors, titles, and affiliations of submitted abstracts, but no full abstract texts. The conference printed booklet will contain full abstract texts from all participants. Conference certificates will be sent to the participants as a PDF document upon request at research@dravetfoundation.eu. Only the name & affiliation will be stated in the certificate, not the email addresses of the participants.

Information is collected by an automated computer system that manages registrations. Security and confidentiality are guaranteed by state-of-the-art technical tools. However, Dravet Syndrome Foundation Spain declines any responsibility concerning data security transmitted through the internet.

Photography
The conference is held in public; therefore, we do not ban participants, exhibitors, partners and other companies from taking photographs of conference activities and participants, and share it via social media. By participating in the conference, you approve that general pictures will be taken and used for our Social Media output, our websites and other communication purposes. You hereby waive any right to oppose, and expressly authorise the organiser to make them available on the Internet or as it may seem fit. Author’s presentation slides shall not be photographed by any conference participant. 

Disclaimer
The conference organiser cannot be held responsible for any loss, injury or damage to any property, whatever the cause may be. Should, for any reason outside the organiser’s control (e.g., political or economic circumstances or a case of ‘force majeure’), the venue or speakers change, or the event be cancelled, the organiser will endeavour to reschedule, but shall not be held responsible for any costs, damages or expenses incurred by the participants. If for any reason the organiser decides to make material changes to this conference, the organiser is not responsible for airfares, hotels or other costs incurred by the participants. The participant takes part in the conference, all tours, and trips at his own risk.

Copyright
The participant is allowed to use the conference documentation exclusively for his/her personal needs.

The conference registration includes: Attendance to all sessions, oral and visual presentations, all coffee and lunch breaks, and conference documentation with all information about the event. The registration does not comprise travelling and accommodation costs or any other personal expenses.

Admittance to the workshop without registration cannot be granted.

In these circumstances, every effort will be made to find an alternative format/venue or propose a new date for the conference. Should the conference be cancelled for any reason, airfares, hotels, or other costs incurred by the participants are not reimbursed by the Dravet Syndrome Foundation Spain.

Any participant is allowed to cancel his/her registration but must notify this to the conference organisers by e-mail at research@dravetfoundation.eu within a minimum of 10 days prior the event. Failure to attend the event without prior written notification by email may incur a no-show fee, which shall cover individual organizational, material and catering costs.

Name Change
All registrations are only valid for the respective person mentioned in the form. A registered participant unable to attend the conference may nominate (free of charge) a substitute participant by notifying the conference organisers by email at research@dravetfoundation.eu before 24th of March 2022. The procedure allows giving the last name, first name, and email address of the new participant.

Personal Data
Upon registration, the participant authorises Dravet Syndrome Foundation Spain to use their personal data stated above to inform the participant of any further conferences, events, or information concerning the conference and Dravet Syndrome Foundation Spain’s activities. The conference booklet online will only contain authors, titles, and affiliations of submitted abstracts, but no full abstract texts. The conference printed booklet will contain full abstract texts from all participants. Conference certificates will be sent to the participants as a PDF document upon request at research@dravetfoundation.eu. Only the name & affiliation will be stated in the certificate, not the email addresses of the participants.

Information is collected by an automated computer system that manages registrations. Security and confidentiality are guaranteed by state-of-the-art technical tools. However, Dravet Syndrome Foundation Spain declines any responsibility concerning data security transmitted through the internet.

Photography
The conference is held in public; therefore, we do not ban participants, exhibitors, partners and other companies from taking photographs of conference activities and participants, and share it via social media. By participating in the conference, you approve that general pictures will be taken and used for our Social Media output, our websites and other communication purposes. You hereby waive any right to oppose, and expressly authorise the organiser to make them available on the Internet or as it may seem fit. Author’s presentation slides shall not be photographed by any conference participant. 

Disclaimer
The conference organiser cannot be held responsible for any loss, injury or damage to any property, whatever the cause may be. Should, for any reason outside the organiser’s control (e.g., political or economic circumstances or a case of ‘force majeure’), the venue or speakers change, or the event be cancelled, the organiser will endeavour to reschedule, but shall not be held responsible for any costs, damages or expenses incurred by the participants. If for any reason the organiser decides to make material changes to this conference, the organiser is not responsible for airfares, hotels or other costs incurred by the participants. The participant takes part in the conference, all tours, and trips at his own risk.

The participant is allowed to use the conference documentation exclusively for his/her personal needs.
